General
No uBp|United Base Players dealer, agent, authorized representitive or employee is authorized to make any amendment to this agreement.
If any provision of this agreement shall be held by a court of competent jurisdiction to be contrary to law, that provision will be enforced to the maximum extent permissible, and the remaining provisions of this agreement will remain in full force and effect.

[uBp] United Base Players and other trademarks contained in the Software are trademarks or registered trademarks of uBp|United Base Players in the United States and/or other countries.
Third party trademarks, trade names, product names and logos may be the trademarks or registered trademarks of their respective owners.
You may not remove or alter any trademark, trade names, product names, logo, copyright or other proprietary notices, legends, symbols or labels in the Software.
This agreement does not authorize you to use uBp|United Base Players' or its licensors' names or any of their respective trademarks.
 
Definitions

All mean the online gaming community UNITED BASE PLAYERS and its authorized representitives, if any.
"Software" means the uBp SITES AND SERVICES.
Any software program and any third party software programs contained therein, in each case supplied by uBp|United Base Players herewith, and corresponding documentation, associated media, printed materials, and online or electronic documentation, and all updates or upgrades of the above that are provided to you.
uBp SITES AND SERVICES specifically means:
Voice communications server specifically hosted by uBp.
Online gaming server(s) hosted by uBp.
Websites, including forums and other websites specifically hosted by uBp.
Email services for the current uBp domains.
"Authorized Representitives" means any current member with a rank of "Founder", "Division Leader" or "Administrator". This does NOT include people with the rank of "Member" or "Recruit".
"Domains" means the following registered domains, sub-domains or folders below the root on each: CLANUBP.COM
CLANUBP.NET
CLANUBP.ORG
UNITEDBASEPLAYERS.NET
UNITEDBASEPLAYERS.ORG

Limits of Use
You may not remove or alter any trademark, trade names, product names, logo, copyright or other proprietary notices, legends, symbols or labels in the Software.
You may not use any copyrighted material or trademarks contained herin unless the copyright or trademark holder gives you express written consent.
 
License Grants & Restrictions
There is no limit to the number of computers you can use the uBp|United Base Players Sites and Services on.
Your license rights under this agreement are non-exclusive (there are other people that have the same agreement).
You may not make or distribute copies of the Software, or electronically transfer the Software from one computer to another or over a network.
You may not alter, merge, modify, adapt or translate the Software, or decompile, reverse engineer, disassemble, or otherwise reduce the Software to a human-perceivable form.
You may not sell, rent, lease, or sublicense the Software.
You may not modify the Software or create derivative works based upon the Software.
You may not export the Software into any country prohibited by the United States Export Administration Act and the regulations there under.
In the event that you fail to comply with this agreement, uBp|United Base Players may terminate the license and you must stop all usage of the Software.
 
Ownership
The foregoing license gives you limited license to use the Software.
uBp|United Base Players and its suppliers and partners retain all right, title and interest, including all copyright and intellectual property rights, in and to, the Software and all copies thereof.
All rights not specifically granted in this agreement, including Federal and International Copyrights, are reserved by uBp|United Base Players, its suppliers and its partners.
 
WARRANTY DISCLAIMER
uBp|United Base Players AND ITS SUPPLIERS AND PARTNERS DISCLAIM ALL WARRANTIES AND REPRESENTATIONS, WHETHER EXPRESS, IMPLIED, OR OTHERWISE, INCLUDING THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ALSO, THERE IS NO WARRANTY OF NON-INFRINGEMENT AND TITLE OR QUIET ENJOYMENT. uBp|United Base Players DOES NOT WARRANT THAT THE SOFTWARE IS ERROR-FREE OR WILL OPERATE WITHOUT INTERRUPTION. NO RIGHTS OR REMEDIES REFERRED TO IN ARTICLE 2A OF THE UCC WILL BE CONFERRED ON YOU UNLESS EXPRESSLY GRANTED HEREIN. THE SOFTWARE IS NOT DESIGNED, INTENDED OR LICENSED FOR USE IN HAZARDOUS ENVIRONMENTS REQUIRING FAIL-SAFE CONTROLS, INCLUDING WITHOUT LIMITATION, THE DESIGN, CONSTRUCTION, MAINTENANCE OR OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CONTROL, AND LIFE SUPPORT OR WEAPONS SYSTEMS. uBp|United Base Players SPECIFICALLY DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTY OF FITNESS FOR SUCH PURPOSES.
IF APPLICABLE LAW REQUIRES ANY WARRANTIES WITH RESPECT TO THE SOFTWARE, ALL SUCH WARRANTIES ARE LIMITED IN DURATION TO NINETY (90) DAYS FROM THE DATE OF DELIVERY OR INITIAL USE.
NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY uBp|United Base Players, ITS DEALERS, DISTRIBUTORS, AGENTS OR EMPLOYEES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF ANY WARRANTY PROVIDED HEREIN.
(USA only) SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE.
uBp|United Base Players shall have no responsibility if the Software has been altered in any way, or FOR ANY failure THAT arises out of use of the Software with other than a recommended hardware configuration, PLATFORM OR OPERATING SYSTEM.
 
LIMITATION OF LIABILITY
NEITHER uBp|United Base Players NOR ITS AUTHORIZED REPRESENTITIVES, SUPPLIERS AND PARTNERS SHALL BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, COVER OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR THE INABILITY TO USE EQUIPMENT OR ACCESS DATA, LOSS OF BUSINESS, LOSS OF PROFITS, BUSINESS INTERRUPTION OR THE LIKE), ARISING OUT OF THE USE OF, OR INABILITY TO USE, THE SOFTWARE AND BASED ON ANY THEORY OF LIABILITY INCLUDING BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF [uBp] OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
uBp|United Base Players' TOTAL LIABILITY TO YOU FOR ACTUAL DAMAGES FOR ANY CAUSE WHATSOEVER WILL BE LIMITED TO ZERO DOLLARS ($0.00).
(USA only) SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OF CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE.

Collection of Your Personal Information
At uBp|United Base Players (henceforth uBp) we ask you to provide a valid email address (required) when registering (or joining) uBp's forums, either as a recruit (and eventually member), public person or allied clan member. We also collect other online communications contact information, such as AOL Instant Messenger or Microsoft Messenger addresses, which is optional and provided at your own purvue. Further, the website automatically tracks IP (Internet Protocol) addresses of each visit to our resources (including but not limited to forum, website, gaming servers, and voice communication servers, henceforth uBp Sites & Services).
In order to access some uBp resources, you will be asked to sign in with a user name and password. This user name and password is for your use only and shall not be transferred or used by any third party with your permission.
We may collect information about your interaction with uBp sites and services. For example, we may use website analytics tools on our site to retrieve information from your browser, including the site you came from, the search engine(s) and the keywords you used to find our site, the pages you view within our site, your browser add-ons, and your browser's width and height. We may also use technologies, such as cookies and web beacons, to collect information about the pages you view, the links you click and other actions you take on our sites and services. Additionally, we collect certain standard information that your browser sends to every website you visit, such as your IP address, browser type and language, access times and referring Web site addresses.
In order to offer you a more consistent and personalized experience in your interactions with uBp, information collected through one uBp service may be combined with information obtained through other uBp services. We may also supplement the information we collect with information obtained from other entities. For example, we may cross-reference your IP address with anti-hacking websites to verify you are a legitimate player and not a cheater before acceptance to uBp.
 
Use of Your Personal Information
uBp collects and uses your personal information to operate and improve its sites and services, as well as defend against cheaters and hackers. These uses may include providing you with more effective customer service; making the sites or services easier to use by eliminating the need for you to repeatedly enter the same information; performing research and analysis aimed at improving our products, services and technologies; and displaying content and advertising that are customized to your interests and preferences.
We also use your personal information to communicate with you. We may send certain mandatory service communications such as welcome letters, information on technical service issues, and security announcements.
Personal information collected on uBp Sites and Services and services may be stored and processed in the United States or any other country in which uBp or its affiliates, subsidiaries or service providers maintain facilities. uBp abides by the safe harbor framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of data from the European Union.
 
Sharing, Accessing and Security of Your Personal Information
We will not disclose your personal information outside of uBp without your consent.
You may have the ability to view or edit your personal information online. In order to help prevent your personal information from being viewed by others, you will be required to sign in with your credentials (user name and password) to the forums.
Some uBp sites or services may collect personal information that is not accessible via the forum system, such as your IP Addresses or GUIDs for video games. If you desire any of this additional information or wish to have it removed, please contact a founder and we can review your request. We will not, however, remove IP Address and GUID information from our database without written legal requests to do so.
uBp is committed to protecting the security of your information, including personal information. We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. For example, we store the personal information you provide on computer systems with limited access, which are located in controlled facilities. When we transmit highly confidential information (such as a password) over the Internet, we protect it through the use of encryption, such as the Secure Socket Layer (SSL) protocol.
If a password is used to help protect your accounts and personal information, it is your responsibility to keep your password confidential. Do not share this information with anyone. If you are sharing a computer with anyone you should always log out before leaving a site or service to protect access to your information from subsequent users.
 
Communication Preferences
The email address that you register with uBp when you sign up for the forums will be your primary means of contact. If any of our administrative staff needs to get in touch with you, they will attempt to use any and all contact information you have voluntarily provided to do so, but will not share said information with a third party unless express written consent is given by you to us.
 
Collection and Use of Children's Personal Information
Many uBp sites and services are intended for general audiences and do not knowingly collect any personal information from children. When a uBp site does collect age information, and users identify themselves as under 13, the site will accept the join request but then when a member of our administrative staff sees this, we will simply delete the request and send an email to the email address provided in said join request stating that the application has been denied. We will not knowingly ask children under the age of 13 to provide any information.
Please note that if you grant consent for your child to use uBp sites or services, this will include such general audience communication services as e-mail, instant messaging, and online groups, and your child will be able to communicate with, and disclose personal information to, other users of all ages. Parents can change or revoke the consent choices previously made, and review, edit or request the deletion of their children's personal information. If we change this privacy statement in a way that expands the collection, use or disclosure of children's personal information to which a parent has previously consented, the parent will be notified and we will be required to obtain the parent's additional consent.
We encourage you to talk with your children about communicating with strangers and disclosing personal information online. You and your child can visit our online safety resources for additional information about using the Internet safely.
 
Use of Cookies
uBp Web sites use "cookies" to enable you to sign in to our services and to help personalize your online experience. A cookie is a small text file that is placed on your hard disk by a Web page server. Cookies contain information that can later be read by a Web server in the domain that issued the cookie to you. Cookies cannot be used to run programs or deliver viruses to your computer.
One of the primary purposes of cookies is to store your preferences and other information on your computer in order to save you time by eliminating the need to repeatedly enter the same information and to display your personalized content and appropriate advertising on your later visits to these sites.
You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to sign in or use other interactive features of uBp sites and services that depend on cookies.
If you choose to accept cookies, you also have the ability to later delete cookies that you have accepted. In Internet Explorer 7, you can delete cookies by selecting "Tools", "Delete browsing history" and clicking the "Delete Cookies" button. If you choose to delete cookies, any settings and preferences controlled by those cookies, including advertising preferences, will be deleted and may need to be recreated.
 
Controlling Unsolicited E-mail ("Spam")
uBp is concerned about controlling unsolicited commercial e-mail, or "spam." uBp has a strict Anti-Spam Policy prohibiting the use of a uBp e-mail account to send spam. uBp will not sell, lease or rent its e-mail subscriber lists to third parties. While uBp continues to actively review and implement new technology, such as expanded filtering features, there is no currently available technology that will totally prevent the sending and receiving of unsolicited e-mail. Using junk e-mail tools and being cautious about the sharing of your e-mail address while online will help reduce the amount of unsolicited e-mail you receive.
